Who processes your data

The data controller is Fine Constructor BV, Chaussée de Helmet 379, 1030 Schaerbeek, Belgium — RPR Brussel (the Brussels register of legal entities), enterprise number 1033.135.023. For anything to do with your data, you reach us directly at info@fineconstructor.be or +32 485 65 94 76. There is nobody in between: you write to the same address the quotes come from.

What data we process

This site is static. There is no contact form on it, there is no account, and you are asked for nothing in order to read what is here. So we only process what you hand us yourself, at the moment you get in touch — and that can happen in three ways. If you call us, we see your telephone number and we note down what we need in order to get back to you: your name, the address where the work has to happen and what the job is about. If you send a WhatsApp message, we process your telephone number, the profile name you set yourself and the content of your messages, including any photos you attach. If you e-mail us, we process your e-mail address, your name and the content of your message and of any attachments. In all three cases it comes down to the same thing: your contact details and what you tell us about your project. On top of that, the host of this site processes technical data that every website needs in order to run and stay secure, including your IP address. We set no cookies and we measure no visitor behaviour; see the cookies page. None of this is compulsory: you decide whether you tell us anything, and what. But without your contact details and a description of the work, we cannot draw up a quote — it will stay a conversation.

What we use it for, and on what legal basis

We use your data to answer your question, draw up a quote and carry out the job if you give it to us. The legal basis for that is your own request and, once there is an order, performance of the contract (Article 6.1.b GDPR). For invoices and accounts we have no choice: that processing rests on a legal obligation (Article 6.1.c GDPR). The technical data the host processes in order to deliver and secure the site rests on our legitimate interest in keeping the site working and safe (Article 6.1.f GDPR). What we do not do: we do not measure visitor behaviour, we do not build profiles and we take no automated decisions about you.

Who gets to see your data

We do not sell your data and we do not pass it on for commercial purposes. It is accessible to us and to the service providers we need in order to work: Cloudflare, Inc., which delivers and secures this site, and our e-mail provider. If you contact us through WhatsApp, that deserves a warning of its own. WhatsApp is a Meta service. Your message travels over their infrastructure, and in doing so Meta processes data under its own terms and outside our reach — we do not decide what happens there to your telephone number or to the data about your use of the app, and we cannot arrange that for you either. What we see is the conversation you have with us. If you would rather not have Meta in between, use the telephone or e-mail; both are on every page of this site. Cloudflare, Inc. is a US company and WhatsApp is a Meta service. With both, data may be processed outside the European Economic Area. Such transfers are covered by the safeguards the GDPR requires; which safeguard applies in a given case, you can ask us at info@fineconstructor.be.

How long we keep it

We do not keep your data longer than is needed for the purpose you handed it to us for. If your enquiry does not lead to an order, we keep it for as long as the conversation runs and for as long as we may reasonably need to come back to it. If it does become an order, we keep the file for as long as the work runs and after that for as long as we have to be able to meet our obligations about it — a contractor who is called to account afterwards has to be able to show what was actually carried out. For invoices and accounting records the period is fixed by law: they have to be kept for 10 years, counting from 1 January of the year following the invoice date. If you want to know what we hold on you at a given moment, or you want us to delete something sooner, just ask.

Your rights

You have the right to ask which data we hold on you and to receive a copy of it, to have it corrected if it is wrong, to have it erased, to have the processing restricted, to object to it, and to receive your data in a common format or have it passed on to somebody else. Where a processing operation rests on your consent, you may withdraw that consent at any time; whatever happened before you withdrew it stays valid. You exercise these rights by e-mailing us at info@fineconstructor.be. We reply within one month. If your request is complicated, or if there are several of them, we may extend that period — but then we tell you why within that first month. If we are unsure who is asking, we may ask you for proof of identity: that is there to protect your data, not to hold you up.

Not satisfied

If you feel we are not handling your data properly, tell us first. In most cases that is the quickest route. Besides that, you always have the right to lodge a complaint with the supervisory authority: the Gegevensbeschermingsautoriteit / Autorité de protection des données (the Belgian data protection authority), Rue de la Presse / Drukpersstraat 35, 1000 Brussels, contact@apd-gba.be.
